The eternal covenant of children with Hashem

במד' ועתה בנים שמעו לי ואשרי דרכי ישמורו אשרי ואשריכם כשיתקיימו כל התנאים הללו כו'.

In the Midrash: "And now, children, listen to Me, and fortunate are those who guard My ways" (Mishlei 8:32) — "fortunate" and "fortunate are you" when all these conditions are fulfilled, and so on.

The Midrash links the tochachah (rebuke) of the parsha to a call to the "children" of Hashem: true good fortune comes when they hold fast to His ways.

דהנה המפ' הקשו למה לא נאמר בתוכחה שכר ועונש הנפש רק מענין הגוף בעוה"ז.

For the commentators raised the difficulty: why is reward and punishment of the soul not mentioned in the tochachah, but only matters of the body in this world?

The rebuke speaks only of physical blessings and curses in this world, with no mention of the soul's reward in the World to Come — and this requires explanation.

אכן באמת עיקר כריתות הברית ביחוד לבנ"י הוא בעוה"ז דוקא.

But in truth, the essence of the cutting of the covenant, specifically with Bnei Yisrael, is precisely in this world.

The unique bris (covenant) Hashem forged with Bnei Yisrael is bound up specifically with this world — which is why the tochachah focuses here.

כי הג"ע לצדיקים וגיהנם לרשעים כבר הוכן מימי בראשית.

For Gan Eden for the tzaddikim and Gehinnom for the wicked were already prepared from the days of Creation.

The reward and punishment of the soul are a fixed part of creation itself, established from the beginning — not something new given through the covenant.

אבל לבנ"י בקבלת התורה נכרת עמהם ברית שנקראו בנים.

But with Bnei Yisrael, at the receiving of the Torah, a covenant was cut with them whereby they are called "children."

What was new at Matan Torah was the bond of children to a father — a relationship that goes beyond mere reward and punishment.

וכדאיתא בזוה"ק ההפרש שבין עבד לבן שעבד יכולין לגרשו אבל הבן א"א לגרש רק ליסרו להפוך דעתו לטוב.

And as it is brought in the Zohar, the difference between a servant and a son: a servant one can dismiss, but a son cannot be dismissed — only chastised, to turn his mind toward the good.

A father cannot disown his son; he can only discipline him. So too Hashem will never cast off Bnei Yisrael — He only corrects them to bring them back.

וזה החילוק בין עשרה מאמרות שניתן הבחירה לאדם כמ"ש במשנה להפרע ולתת שכר.

And this is the distinction regarding the Ten Utterances (of Creation), where free choice was given to man, as the Mishnah states — "to exact punishment and to grant reward."

The world created through the Ten Utterances operates on a system of bechirah (free will), reward, and punishment for all mankind.

הרי אמרו שיכולין הרשעים לאבד העולם שנברא בעשרה מאמרות.

Indeed, they said that the wicked can destroy the world that was created with the Ten Utterances.

Because that world depends on free will, wicked people can actually forfeit and ruin it.

ועליהם נאמר ומשלם לשונאיו אל פניו להאבידו.

And concerning them it is said, "And He repays His enemies to their face, to destroy them" (Devarim 7:10).

For such people, who break from Hashem entirely, the result can be total loss.

אבל העשרת הדיברות הם גזירות והנהגות אמיתיות חיים וקיימים לעד.

But the Ten Commandments are decrees and true modes of conduct, living and enduring forever.

The Torah given at Sinai is not a conditional arrangement but an eternal, unbreakable bond.

ולכן ניתן עם התורה כל העונשים שבעוה"ז כמ"ש סייף ומקל ירדו עם התורה וז"ש בתוך העונשין וזכרתי כו' בריתי יעקב כו' כי זה כריתות הברית שאע"פ שיחטאו יענשו בעוה"ז ולא יהיו נכרתין ח"ו משורש דביקותם בהקב"ה ובוודאי כן הוא בכלל ישראל וזה עצמו מ"ש הראשונים ז"ל כי אפי' תמה זכות אבות ברית אבות לא תמה.

Therefore all the punishments of this world were given together with the Torah, as they said, "the sword and the staff descended with the Torah." And this is the meaning of the verse amid the punishments, "And I will remember… My covenant with Yaakov…" (Vayikra 26:42) — for this is the cutting of the covenant: that even when they sin, they are punished in this world, but they are not, Heaven forbid, cut off from the root of their attachment to the Holy One, blessed is He. And surely this is so regarding the whole of Yisrael. And this itself is what the Rishonim said: even if the merit of the Avos is exhausted, the covenant of the Avos is not exhausted.

The worldly punishments of the tochachah are themselves an expression of the covenant of children: a son is disciplined here, in this world, but his essential bond with his Father is never severed. Even should the merit of the Avos run out, the covenant of the Avos endures.

פי' זכות האבות שמסייעת שילכו בנ"י בדרך אבות.

The explanation: the merit of the Avos is what helps Bnei Yisrael to walk in the path of the Avos.

Zechus Avos (the merit of the forefathers) functions as positive assistance, supporting Bnei Yisrael in following their ancestors' ways.

אבל אפי' כשיתרחקו מדרך האבות.

But even when they distance themselves from the path of the Avos —

And what happens when that merit no longer helps, when they have strayed?

הי' הברית שיענשו בגוף עד שיתקנו מעשיהם לטוב.

— there was the covenant, that they would be punished in the body until they mend their deeds for the good.

The bris Avos guarantees that even a straying son is only chastised bodily, never abandoned, until he repairs his ways.

ולכן אמר אשרי ואשריכם כמ"ש רש"י ז"ל פ' נצבים הואיל ונשבע לאבותיכם וא"י לנתק מכם לכן אוסר אתכם בשבועות הללו ע"ש:

Therefore it says "fortunate" and "fortunate are you," as Rashi explains in Parshas Nitzavim: since He swore to your fathers and cannot detach Himself from you, He therefore binds you with these oaths; see there.

Precisely because Hashem can never let go of Bnei Yisrael, He "binds" them through the covenant's oaths — and that inescapable bond is itself their good fortune.

Summary: The tochachah speaks only of bodily reward and punishment in this world because the unique covenant Hashem made with Bnei Yisrael is the bond of children to a Father. A son can be disciplined but never disowned; even if zechus Avos is exhausted, the bris Avos endures. The very oaths that bind Israel are the sign that Hashem will never sever His attachment to them.
