Mishpatim 5640 תר”מ
ואלה המשפטים אשר תשים לפניהם.
“And these are the laws that you shall place before them”
במד’ מגיד דבריו ליעקב חקיו ומשפטיו לישראל כו’.
The Midrash (Shemos Rabbah 30:9) He teaches His words to Yaakov etc. (explains that the traits of HaShem are unlike a human king. Whereas a human kind would command his nation to keep certain laws he himself is not bound by them. However HaShem has given us the Torah and the law of the Torah can follow the decisions of Beis Din).
כי יש כמה משפטים לכל עולמות וברואים כפי מדריגותיהם ולבנ”י ניתן אלה המשפטים והם משפטי ה’ אמת. והם משפטים של התורה באמת.
This is because there are many levels of laws for the different (spiritual) worlds, and creations each according to their level. These laws were all given to Bnei Yisrael and they are the true laws, these are the true laws of the Torah.
ז”ש רש”י מה הראשונים מסיני.
This is the meaning of Rashi (Shemos 21:1) Just as the first commandments were (clearly) given on Har Sinai (so too these were also given on Har Sinai.)
ובמד’ תנחומא ע”פ ועוז מלך משפט אהב אמר כי גבור בו”ד אינו שומע למשפט אבל הבורא ית’ שהוא עזוז וגבור ומשפט אהב.
The Midrash Tanchuma explains the words of the pasuk (Tehillim 99:4) “The mighty King who loves justice”, explains how a mighty human warrior, does not necessarily follow the laws, however HaShem who is mighty and valiant, loves justice.
והשי”ת שנתן התורה לבנ”י ה’ עוז לעמו יתן שע”י התורה ניתן לבנ”י הכח להטות כל הבריאה וזה עצמו פי’ מגיד דבריו כו’ הדברות שהוא הנהגת כל הבריאה כי הכל באורייתא אשתכלל.
Now HaShem who has given the Torah to Bnei Yisrael (as the pasuk states) “HaShem has given strength to His nation”, it is through the Torah that the power is given to direct the entire creation. This indeed is itself the idea of “He tells His words to Yaakov etc”. These “words” are the directive for the entire creation, for everything is included in the Torah.
לכן מסר לבנ”י גם המשפטים כיון שהעולם תלוי בהם. ז”ש במד’ שופטים ע”פ לא תטה משפט דע שאתה מזעזע אחד מרגלי עולם וע”ש:
Therefore He has given the laws to Bnei Yisrael, since the world is dependent on them. This is the meaning of the Midrash in Shoftim on the words “do not perverse justice” (The Midrash explains that by perverting justice) “Know that you are shaking one of the foundations of the world.
