Eretz Yisrael won through human effort

spies · Eretz Yisrael · Oral Torah · human effort · forty days

And the matter of "Shlach lecha" (Send for yourself) — "according to your own understanding; if you wish, send" (Rashi).

The Torah leaves the sending of the spies to Bnei Yisrael's own initiative. Hashem does not command it outright but places the decision in their hands.

For the aspect of Eretz Yisrael is Torah she'be'al peh (the Oral Torah), which a person must establish through the power of his own toil (yegi'ah).

Eretz Yisrael corresponds to the Oral Torah — a realm not handed over ready-made but acquired only through a person's own effort and labor.

Therefore the conquest of Eretz Yisrael depends on the will (ratzon) of Bnei Yisrael themselves, as it is written "and it shall be conquered (v'nichbeshah)," and the Holy One, blessed is He, consents and assists them.

Because the Land is acquired through human effort, its conquest hinges on Bnei Yisrael's own desire. When they take the initiative, Hashem agrees and lends His help — but the first move must come from them.

Therefore, when they rejected the Land, they could no longer enter it.

Since entry depended on their own ratzon, once that desire collapsed into rejection, the entire generation forfeited its ability to enter.

And in those forty days (of the spies' mission), had they withstood the test (nisayon), they would have rectified the aspect of Torah she'be'al peh. And just as Moshe Rabbeinu, peace be upon him, was on the mountain forty days to receive the Torah (she'biksav), so too these forty days were the preparation for the Oral Torah and Eretz Yisrael.

The forty days of the spies parallel Moshe's forty days on Har Sinai. As Moshe's forty days brought down the Written Torah, the spies' forty days were meant to prepare and establish the Oral Torah and the Land — had Bnei Yisrael passed the test.

Corresponding to the form of the fetus (the embryo), which is the image of a complete person with its 248 (limbs) and 365 (sinews).

Forty days is also the period after which the embryo takes form as a whole human being, with its 248 limbs and 365 sinews — paralleling the 248 positive and 365 negative mitzvos. These forty days were meant to form a complete spiritual "body."

And it is written, "And they came until the Valley of Eshkol, etc."

The Sefas Emes now turns to the specific place the spies reached, Nachal Eshkol, named for the cluster of grapes they cut there.

And since the verse singles out the place — "therefore he called it (the Valley of Eshkol)..." — it appears that they merited to find the penimiyus (inner point) of Eretz Yisrael that is unique to them.

The Torah's emphasis on naming this spot signals that at Nachal Eshkol the spies touched the inner essence of the Land — the hidden point of Eretz Yisrael uniquely bound to Bnei Yisrael.

As it is written, "one nation in the land (goy echad ba'aretz)" (Shmuel II 7:23).

Bnei Yisrael are uniquely "one nation in the land" — their oneness is bound up specifically with Eretz Yisrael, the place where their inner unity is realized.

A hint to the matter: "Eshkol Anavim" (cluster of grapes) plus "echad" (one) equals the gematria of "Yisrael" with the addition of one (im ha'kollel).

The Sefas Emes brings a gematria: the numerical value of "Eshkol Anavim" together with "echad" equals "Yisrael" (counting the kollel). The cluster, oneness, and the name Yisrael are numerically intertwined — confirming the link between Nachal Eshkol and Yisrael's unity.

And since it is written "Eshkol" (a cluster), we already know that it is one — why then is "echad" (one, in the verse " chevel echad / one band") needed?

A cluster (eshkol) is by definition a single unit, so stating "one" seems redundant. The Sefas Emes presses this apparent superfluity to extract a deeper meaning.

Rather, it is to hint that it is "one cluster," the singular one (ha'meyuchad) in the Land. And when they sinned, they were afterward required to return and rectify (the matter), to be prepared for Eretz Yisrael — forty years, "a day for a year."

The extra "one" teaches that this cluster represents the unique, unified bond of Yisrael with the Land. Once they sinned by rejecting it, the swift forty-day preparation collapsed and had to be redone the hard way — forty years of wandering, a year for each day, to refit them for entry.

And that which they would have rectified beforehand in a single day, they afterward needed an entire year (to accomplish).

The sin exacted a steep cost: the inner rectification that could have been achieved in one day now demanded a full year of labor for each of the forty days. The opportunity for swift, effort-driven acquisition of the Land was traded for a long, painful tikkun.

Summary: "Shlach lecha" places the sending of the spies in Bnei Yisrael's own hands because Eretz Yisrael corresponds to Torah she'be'al peh, which is acquired only through a person's own toil and ratzon — Hashem consents and assists, but the desire must come from below. The forty days of the spies paralleled Moshe's forty days on Sinai (Written Torah) and the forty days of the fetus forming a complete body of 248 limbs and 365 sinews; had Bnei Yisrael withstood the test, they would have rectified the Oral Torah and the Land. At Nachal Eshkol they touched the penimiyus of the Land, the unique "one cluster" bound to Yisrael's oneness (supported by gematria). But by rejecting the Land they forfeited the swift, one-day acquisition and were sentenced to forty years, a year for each day — turning what could have been accomplished in a day into the labor of a full year.
