Truthful Judgment Connects the Worlds
מבוקר עד ערב אפשר לומר כן אלא כל דיין שדן דין אמת לאמיתו כו'.
“From morning until evening one may say this; rather, any judge who judges a true judgment…”
The Sefat Emet begins by explaining that the phrase “from morning until evening” refers to the spiritual significance of rendering true judgment, not merely the passage of time.
וקשה א"כ מה אמר יתרו נבול תבול כו'.
“But if so, it is difficult: what did Yitro mean by saying, ‘You will surely wear yourself out’?”
The question arises: if judging is so elevated, why would Yitro criticize Moses’ method as unsustainable?
אך אמת כי גם במצות פשוטי בני אדם לעשות דין ומשפט בין איש לרעהו.
“But the truth is that even the simple mitzvah of rendering justice between one person and another…”
Even ordinary civil judgment holds tremendous spiritual power.
אם הוא באמת הוא דבר גדול.
“If it is done in truth, it is something great.”
Authentic justice connects deeply with holiness.
ונאמר עליו מבוקר עד ערב.
“And regarding it the Torah says, ‘from morning until evening.’”
This phrase signals the cosmic reach of true judgment.
שמתקשרין עי"ז כל העולמות וממשיך האמת עד דרגא תחתונה.
“For through it all the worlds become connected, drawing truth down to the lowest level.”
Judgment done truthfully unifies spiritual realms and brings divine truth into the material world.
והוא באמת נחמה לדיינים העוסקים בצורכי ציבור שנאמר בגמרא ומד' שעי"ז באין לביטול תורה רק שגדולה מצוה בשעתה.
“And this is truly a comfort to judges who serve the needs of the community… for although it leads to some neglect of Torah study, the mitzvah of the moment is great.”
The Sefat Emet encourages judges, explaining that their work, though time‑consuming, carries immense spiritual value.
אבל מדרגת מרע"ה שנאמר עליו כל עליותיו בהשכמה היו הוא למעלה מזו המדרגה מבוקר עד ערב.
“But the level of Moses, of whom it is said that all his ascents were early, was above this level of ‘from morning until evening.’”
Moses functioned on a spiritual plane beyond the system of ordinary judgment.
ועצת יתרו הי' אליו לפי מדרגתו.
“And Yitro’s advice was directed to him according to his (Yitro’s) own level.”
Yitro’s counsel reflected his perspective, not Moses’ true spiritual capacity.
ובס' אוה"ח פי' וצוך אלקים ויכלת עמוד.
“And the Or HaChaim explains the verse ‘God will command you, and you will be able to stand.’”
The Or HaChaim gives a mystical reading of the divine guidance in judging.
שעי"ז יהי' פנוי לקבל מאמר אלקים ע"ש בדבריו הקדושים.
“That through this Moses would be free to receive God’s word.”
Delegating judgment would theoretically open Moses to even greater prophetic reception.
וכ"כ בתרגום יונתן.
“And so writes Targum Yonatan.”
The idea is supported by Aramaic tradition.
עכ"ז ראינו כי לא הוטב העצה בעיני מרע"ה.
“Nevertheless, we see that the advice was not pleasing in Moses’ eyes.”
Moses did not fully embrace Yitro’s proposal.
כי בודאי אם הי' נשאר כן.
“For surely, if he had remained as he was…”
Had Moses continued judging alone, something far greater might have occurred.
הי' מרע"ה מתקן הכל להיות נמשכין כל בנ"י אחר מדרגתו.
“Moses would have rectified everything, causing all Israel to be drawn after his level.”
Moses’ spiritual stature had the power to elevate the entire nation.
כמו שהי' שליח להוציאנו ממצרים ממ"ט שערי טומאה.
“Just as he was the emissary to bring us out of Egypt, from the forty‑nine gates of impurity…”
Moses had previously lifted all Israel from profound spiritual descent.
כן הי' בכחו ג"כ להמשיך כל בנ"י אחריו.
“So too he had the power to draw all Israel after him.”
Moses’ leadership could have elevated them spiritually even further.
אבל נראה כי גם זה הי' בעצת עמלק הרשע.
“But it appears that this too was influenced by the counsel of the wicked Amalek.”
The Sefat Emet shocks: Amalek subtly undermined Israel’s ability to rise with Moses.
שע"י שהוקרו בנ"י מכוחם במלחמת עמלק ימ"ש.
“Because Israel was weakened in their spiritual strength in the war with Amalek.”
Amalek diminished Israel’s capacity to cleave to Moses’ level.
לא היו יכולין להמשך אחר מדריגת מרע"ה.
“They were no longer able to be drawn after Moses’ level.”
Due to Amalek’s impact, Israel could not sustain Moses’ spiritual intensity.
וראי' לדבר שבמלחמת עמלק סילק מרע"ה עצמו ושלח את יהושע כנודע.
“And proof: in the war with Amalek, Moses withdrew himself and sent Joshua, as is known.”
Moses’ partial withdrawal shows that Amalek impeded full connection between Moses and the people.
The Sefat Emet explains that true judgment unifies worlds, and Moses’ own level transcended ordinary judicial structures. Yitro’s advice reflected his perspective, not Moses’. Had Moses judged alone, he might have elevated all Israel—were it not for the spiritual damage inflicted by Amalek, which reduced Israel’s ability to rise with him.
