Torah recaptured: refining holy sparks below

ובמדרש ומשה עלה כו' עלית למרום שבית שבי כו'.

And in the Midrash: "And Moshe went up [to God]" (Shemos 19:3) — "You ascended on high, you took captives" (Tehillim 68:19).

The Sefas Emes opens with the Midrash that links Moshe's ascent to receive the Torah with the verse describing taking the Torah as "captive."

יכול מפני ששבה אותה ניתנה לו בחנם ת"ל לקחת.

One might think that because he took it captive, it was given to him for free — therefore the pasuk says "lakachta" (you took/acquired it).

The Midrash asks whether the Torah was simply seized at no cost, and answers that the word "took/acquired" implies it was obtained as a genuine acquisition.

יכול נתן דמים ת"ל מתנות.

One might think he paid a price — therefore the pasuk says "matanos" (gifts).

Yet the word "gifts" shows it was not purchased either; it was given freely.

בזכות האבות כו' ע"ש כל הענין.

[It was given] in the merit of the Avos, etc. — see there the whole matter.

The Midrash concludes that the Torah came as a gift earned through the merit of the forefathers. The Sefas Emes now unpacks this.

דהנה הכ' תולה כל התורה והמצות ביצ"מ.

For behold, the pasuk makes all of the Torah and the mitzvos dependent upon Yetzias Mitzrayim (the Exodus).

Scripture repeatedly grounds the Torah and its commandments in the Exodus from Mitzrayim.

וכ"כ בהוציאך כו' תעבדון כו' על ההר הזה.

And so it is written, "When you bring [the people] out [of Mitzrayim], you shall serve [God] upon this mountain" (Shemos 3:12).

The Exodus was the precondition for receiving the Torah and serving Hashem at Sinai.

דהנה עיקר שכינה בתחתונים הי' קודם החטא.

For the essential dwelling of the Shechinah among the lower [worlds] was [present] before the sin.

Before the sin of Adam, Hashem's presence rested fully within the physical world.

וע"י החטא נתפזרו ני"ק במקומות לא טובים.

And through the sin, the nitzotzos kedoshos (holy sparks) became scattered into places that are not good.

The sin dispersed the holy sparks, sinking them into the lower, impure realms.

וכמו כן לעומת זה נתעלו השרשים שבקדושה למעלה.

And correspondingly, the roots of holiness were elevated upward.

As the sparks fell below, their spiritual roots withdrew to a higher place above.

כי זה לעומת זה עשה אלקים.

For "God made one corresponding to the other" (Koheles 7:14).

Creation is structured in parallels: a descent below mirrors an ascent above.

והאדם כולל עליונים ותחתונים.

And the human being includes both the upper and the lower [worlds].

Man is a microcosm encompassing both higher and lower realms.

וכפי תיקון הגוף למטה.

And in accordance with the rectification of the body below.

The degree to which one refines the physical body below determines what is drawn down.

כך מתפשטת כח הנשמה מלמעלה.

So too the power of the neshamah spreads down from above.

Refining the body draws an increased flow of soul-power from above.

וכפי ירידת הגוף כך מתעלה הנשמה למעלה.

And in accordance with the lowering of the body, so the neshamah is elevated above.

The more one subdues bodily desire, the higher the neshamah rises.

וביצ"מ ביררו בנ"י הני"ק שנתפזרו למטה.

And at Yetzias Mitzrayim, Bnei Yisrael sorted out (refined) the holy sparks that had been scattered below.

The Exodus accomplished the birur — the gathering and elevation of the holy sparks that had fallen into Mitzrayim.

ולכן זכו אח"ז להחזיר להם כח הנשמה מלמעלה בכח התורה.

And therefore they merited afterward to have the power of the neshamah restored to them from above, through the power of the Torah.

Having refined the sparks below, they earned the return of soul-power from above by means of the Torah given at Sinai.

ולכן כ' משיבת נפש כי התורה מחזרת הארת הנפש והנשמה אל האדם.

And therefore it is written, "[the Torah of Hashem is perfect,] restoring the soul" (Tehillim 19:8) — for the Torah returns the illumination of the nefesh and neshamah to a person.

The Torah is "meshivas nefesh" precisely because it restores the lost light of the soul.

ומעולם התורה מיוחדת לבנ"י.

And from the very beginning, the Torah is uniquely connected to Bnei Yisrael.

The Torah belonged to Bnei Yisrael from the outset.

אך שנשבה למעלה ע"י החטא.

Except that it was "taken captive" above on account of the sin.

The sin had caused the Torah to be withdrawn upward, out of reach.

לכן כ' שבית שבי.

Therefore it is written, "you took captive the captive."

Moshe's ascent "recaptured" what had been taken captive by the sin — restoring the Torah to Bnei Yisrael.

ולכן הי' צריך להיות בחנם.

And therefore it had to be [given] for free.

Since the Torah was originally theirs, returning it was a free gift, not a purchase.

אבל ע"י החטא צריכין מקודם יגיעה כמ"ש התקן עצמך ללמוד תורה.

But because of the sin, one must first exert effort, as it is said, "Prepare yourself to learn Torah" (Avos 2:12).

Though it is a gift, the sin made prior toil necessary — one must labor to make oneself a fit vessel for the Torah.

ובחי' זו שנק' שבית שבי.

And this aspect that is called "you took captive the captive."

The Sefas Emes now identifies which forefather this "recaptured" Torah corresponds to.

הוא בחי' יעקב.

It is the aspect of Yaakov.

The recaptured, essential Torah corresponds to Yaakov Avinu.

שצורתו חקוקה תחת כה"כ.

Whose image is engraved beneath the kisei ha-kavod (the Throne of Glory).

Yaakov's form is engraved beneath Hashem's Throne, marking his rootedness in the highest realm.

והוא עצם התורה.

And he is the very essence of the Torah.

Yaakov embodies the Torah's inner essence itself.

ויש כאן בחי' ג' אבות.

And here there is the aspect of all three Avos.

The Midrash's three terms — gifts, taking, and merit of the Avos — correspond to the three forefathers.

מתנות באדם הוא אברהם.

"Gifts among men" (Tehillim 68:19) corresponds to Avraham.

The "gifts" given freely reflect Avraham's attribute of chesed.

לקחת הוא בחי' יצחק במדה"ד.

"You took/acquired" is the aspect of Yitzchak, [associated] with middas ha-din (the attribute of strict judgment).

The notion of acquiring through a price reflects Yitzchak's attribute of din.

אבל בחי' יעקב היא התורה המיוחדת לו מעולם.

But the aspect of Yaakov is the Torah that is uniquely his from the very beginning.

Yaakov represents the Torah as the eternal inheritance of Bnei Yisrael, beyond both free gift and acquisition.

ולכן מצינו באברהם ויצחק דברים פרטים בצדקתם.

And therefore we find with Avraham and Yitzchak specific deeds in their righteousness.

Avraham and Yitzchak each had particular tests that demonstrated their righteousness.

אברהם נתנסה י' נסיונות.

Avraham was tested with ten trials.

Avraham's greatness was proven through ten specific nisyonos.

יצחק בעקידה.

Yitzchak [was tested] at the Akeidah.

Yitzchak's defining act was his self-offering at the Binding.

אבל יעקב כתיב בי' איש תם.

But of Yaakov it is written, "a wholesome man" (Bereishis 25:27).

Yaakov is not defined by isolated trials but by an all-encompassing wholeness — "tam."

וכ"כ תתן אמת ליעקב.

And so it is written, "Grant truth to Yaakov" (Michah 7:20).

Yaakov's midah is emes (truth), the all-embracing attribute corresponding to the Torah.

יעקב חבל נחלתו.

"Yaakov is the portion of His inheritance" (Devarim 32:9).

Yaakov is Hashem's own inheritance, just as the Torah is Bnei Yisrael's eternal portion.

וכ' יודיע דרכיו למשה לבנ"י עלילותיו.

And it is written, "He made known His ways to Moshe, His deeds to Bnei Yisrael" (Tehillim 103:7).

The pasuk distinguishes between what Moshe received from above and what Bnei Yisrael accomplished below.

היינו שבנ"י תיקנו במצרים חלק העשי' למטה.

That is, Bnei Yisrael rectified, in Mitzrayim, the portion of action (asiyah) below.

"His deeds to Bnei Yisrael" refers to the work of refinement Bnei Yisrael did in Mitzrayim, in the realm of deed.

ומשה עלה והוריד להם החלק שלמעלה.

And Moshe ascended and brought down to them the portion that is above.

Moshe's role was to ascend and draw down the higher portion — the Torah — to complement their work below.

התורה שנק' דרך.

The Torah, which is called "way" (derech).

"His ways to Moshe" refers to the Torah, which is termed a "way."

וב' אלו הם בחי' נעשה ונשמע.

And these two are the aspects of "na'aseh" (we will do) and "nishma" (we will hear).

The work below and the Torah from above correspond to Bnei Yisrael's famous declaration "na'aseh v'nishma."

ואמו"ז ז"ל אמר על המד' קלקלתם נעשה הזהרו בנשמע.

And my grandfather, of blessed memory, said regarding the Midrash, "You have damaged 'na'aseh,' [now] be careful with 'nishma.'"

The Sefas Emes cites his grandfather (the Chiddushei HaRim) on the Midrash that, after the sin of the Golden Calf, Bnei Yisrael were warned to safeguard "nishma."

שאין הפי' שלא לעשות.

That the meaning is not that they should cease doing.

The warning does not mean to abandon action (na'aseh).

רק שקודם החטא זכו לשמוע בכח הקדמת הנעשה.

Rather, that before the sin they merited to "hear" through the power of having placed "we will do" first.

Originally, putting na'aseh before nishma had given them the power to truly hear and receive.

ועתה השמיעה מסייעת לתקן העשי' כו'.

And now, [after the sin,] the "hearing" assists in rectifying the "doing."

After the sin damaged the realm of action, the order is reversed: hearing (Torah) now serves to repair the deed.

והוא כמ"ש כי הראשונים הקדימו לברר הבירורים למטה ועי"ז זכו לירידת השפע מלמעלה.

And this is as we have said: that the early ones (the Avos and the generation of the Exodus) first performed the biruirim (refinements) below, and through this they merited the descent of shefa (divine abundance) from above.

The earlier generations did the work of refining the sparks below first, and thereby earned the downpour of divine influence from above.

ועתה עכ"פ צריכין בכח התורה לברר הניצ"ק:

And now, in any case, we must — through the power of the Torah — refine the nitzotzos kedoshos (holy sparks).

In our generation the order is reversed: we use the Torah received from above as our tool to accomplish the refinement of the holy sparks below.

Summary: The Midrash on Moshe's ascent teaches that the Torah was "taken captive" — it had always belonged to Bnei Yisrael but was withdrawn on high through Adam's sin, which scattered the holy sparks below. By refining those sparks in Mitzrayim, Bnei Yisrael earned the Torah's return as a free gift that "restores the soul." The Midrash's three terms — gifts, acquisition, and the merit of the Avos — correspond to Avraham (chesed), Yitzchak (din), and Yaakov, who is the very essence of Torah and emes. This is na'aseh and nishma: the Avos first refined the deed below and drew shefa from above, while after the Golden Calf we now use the Torah's "hearing" to rectify our action and refine the holy sparks.
